69 Petitioners had challenged the imposition of Additional Development Tax levied by DHA Peshawar through Barrister Babar Shahzad Imran ASC, head Barrister Babar Chambers in Peshawar High Court, Peshawar. A PHC bench comprising of Justice Arshad Ali and Justice fazal Subhan heard the Writ Petition wherein Barrister Babar asserted that the imposition of ADC by DHA is illegal, discriminatory and without any legal or reasonable basis at all. Moreover, there is no concept of ADC in DHA Act, 2009. He also stated that the reason for ADC given by DHA is inflation however inflation has gone down in the recent years and the ADC imposed is tainted with mala fide.
The honourable bench was please to issue notice to DHA and Government of KP and has also issued a stay order against cancellation of any plots if ADC is not paid by the plot owners.The case has been adjourned for comments of DHA.
